Customer is responsible for making their own determination as to what shipping method to utilize and what amount of insurance shall be purchased for each shipment made to NGS. NGS shall not be liable for any losses incurred by customer during shipment. Customer bears all risk of loss or damage during shipping to us, and you are responsible for appropriately wrapping, protecting, shipping, and insuring all coins during the process of shipping or delivery to us. We are not responsible for any Items unless and until received, and verified by us to be received, in good condition (including without limitation not damaged or lost during shipping, and that the package actually includes all Item(s) listed on the submission form), eligible and matching your description(s) on the submission form..
When we return Items to you, they will be insured either by you, if you provide your own shipping account and insurance information for such use, or by us, at your expense, for the Declared Value. Once we deliver or submit the Item(s) to (or they are picked up by you or your agent) by your designated return shipping service, we are no longer responsible for any risk of loss or damage, and any loss or damage is solely the responsibility of the return shipping service. You must inspect all Items immediately upon receipt, and we disclaim any liability for damage or discrepancies or errors, including but not limited to errors in the description of the Item, unless reported by you to us in writing within ten (10) days of the date the applicable coin(s) was/were shipped back to you. The customer has to take the delivery of their Property once the grading process is complete and they have been informed about the same. The customer has to take their full delivery within 1 (one) month of such delivery intimation after paying all pending fees and charges. NGS has the right to charge demurrage @ 1% per month on the declared value of the Items if delivery of the Property is not taken by the customer after 1 (one) month of such delivery intimation. In case the delivery of the Property is not taken by the customer after 6 months of intimation, NGS reserves the right to sell off the concerned Property by auction/privately, without any prior notice and dues to the customer.
The NGS certification/slab/holder (collectively, the “slab”) is provided upon the request of the customer. NGS Grading is committed to grade only genuine items. However, it does not guarantee authenticity or attribution, nor is any guarantee of these aspects implied. NGS will only holder items it considers genuine at the time of submission, but it does not guarantee the authenticity, genuineness, type, attribution or date of any item it holders. Therefore, NGS only guarantees the grade. By making this slab, NGS does not agree to purchase the Item. Neither the customer nor any subsequent purchaser/s of the Item shall regard this slab as a document of valuation or appraisal or as a guarantee or warranty. All eligible Items reviewed, identified, certified, graded and/or inserted into NGS holders by NGS are guaranteed (to the eligible owner) to be not materially over-graded, according to the Terms, Conditions, Limitations and Disclaimers in our Policy, found here/on our website. A customer is also advised to verify authenticity of an NGS slab on its website, before making any commercial deal with the seller. The NGS is not responsible for the Items that have been tooled/removed at any time from their original NGS Slabs/holders We are not responsible for tampered, fake, counterfeit or tooled NGS holders. The authenticity, attribution and dating of ancient/vintage/contemporary items like coins are often a matter of scholarly conjecture. Different scholarly theories can coexist, each simultaneously finding acceptance within the scholarly/collector community. In such cases, NGS will use the theory it considers most valid. New research may challenge or change the consensus about an item’s attribution, date, identification and even its authenticity. Consequently, the opinion of NGS on these matters is subject to change with the introduction of new information, or of existing information of which its expert/grading staff was unaware at the time of grading. Every effort is made in good faith by NGS to properly attribute an item, but no guarantee is made as to the authenticity and attribution. Neither NGS nor any of its stakeholders, officers, experts, advisors and/or staff shall, at any time; be held responsible for any discrepancy which may result from the application of other theory/research/grading methods. In the event of any claim by the customer or any other person for damages resulting directly or indirectly, from this slab, the liability of NGS shall be limited to the actual amount it received as charges in connection with that slab. It is recommended that buyers purchase items from sellers who offer unconditional lifetime guarantee of authenticity.
NGS utilizes best business practices to attempt to grade/conserve all Items received within its currently published turnaround time frame. However, such time frames are non-binding goals, not guarantees. NGS is not liable in any manner whatsoever to any customer for any types of loss or damages, incidental or consequential due to delays or failure of NGS to grade/conserve any Item within such published time frame. Turnaround times do not include mailing time and reflect business/working days.
While NGS will use due care during handling all submitted Items, some Items submitted could be in an extremely fragile state and it may not be possible to not damage such an item while it is being graded/conserved. Customer acknowledges this risk and releases NGS of any liability associated with such unavoidable damage which may occur during conservation/grading, handling or shipping.
NGS reserves the right to return any Item submitted without being graded/slabbed if such Item is judged by NGS, in its sole discretion, to be fake, copy, counterfeit, tampered, altered, tooled, doctored, or No Decision can be taken of or an item that NGS does not grade. Customer shall remain responsible to pay all submission fees in connection with such returned Items and these fees are NON-REFUNDABLE. If NGS determines that the submitted Item to be of Questionable Authenticity / Ineligible Type, each of the Item will be charged at Rs. 500 as grading charges and remaining amount will be refunded. If a customer repeatedly submits counterfeit or tooled Items, NGS reserves the right, in its sole discretion, to refuse any future submissions from such customer and/or to suspend customer’s account.
If customer indicates on the Submission Form that an Item submitted from a different grading service is being submitted to cross over to an NGS holder, then customer consents that such Item may be removed from its holder. Customer acknowledges that NGS is not obligated to contact customer to confirm any instructions given on the Submission Form. The customer further acknowledges the inherent risks in removing an item from its holder and agrees to waive any claim for damages against NGS, its stakeholders, directors, officers, agents, experts, advisors, and/or employees in connection with any loss or damage arising out of NGS’s fulfilment of customer’s request to remove an item from its holder. Customer further acknowledges that removal of an item from its holder may, in and of itself, cause a loss of value. For example, it is possible that a coin has an edge damage and the existing holder may hide such a damage. NGS is not liable for any loss of value to the coin under such or similar circumstances.

Authentication, identification, certification and/or grading are individual OPINIONS that are SUBJECTIVE and require the exercise of professional Opinion, which can CHANGE from time to time. Conclusions of this certification/slab reflect the findings AT THE TIME OF SUBMISSION. Nevertheless, NGS takes due professional expertise, care and available resources in authentication, identification, certification and/or grading the Items submitted. However, NGS makes no warranty or representation and shall have no liability whatsoever to customer for the certification/grade assigned by NGS to any Item. Notwithstanding anything to the contrary contained herein, the Maximum Aggregate Liability that NGS shall have to you, or any third party for whom you may be acting, arising from any cause, identification, authentication, act, omission, certification and/or other circumstances; shall in no event EXCEED the LESSER of the FEE or the amount actually paid by you for the services rendered by us with respect to the applicable Item(s) submitted hereunder. In no event shall NGS or any of our affiliates, or any of our or their respective stakeholders, employees, officers, directors, staff, experts, advisors and/or agents, be liable to customer or any other party for any direct, indirect, incidental, spatial, consequential or exemplary damages (including without limitation, business interruption damage, costs of delay or lost profits), howsoever caused, as a result of any negligence, breach of contract, misrepresentation, authenticity, or otherwise, even if advised of the possibility of such damages. Furthermore, in case of any difference of opinion for an identification/authentication of a slab issued, NGS on its sole discretion may delete such a certification/slab from its website/records without any notice. Except as expressly set forth herein to the contrary, all Services are provided “as is”, and NGS disclaims any and all warranties, expressed or implied, regarding our products and services, including but not limited to the warranties of merchantability and fitness for a particular purpose.
NGS compiles data regarding each Item submitted, including, but not limited to, data relating to the identity, minting, condition and grade of the Item as well as statistics regarding usage of our services (collectively, the “Data”). NGS may collect images, photograph, digital, video, animated files, interactive viewing software, virtual simulations or other rich media, of each Item submitted, with and/or without its Holder/Slab (collectively, the “Images”). NGS owns and has all rights in and to such Data & Images, including without limitation the rights to use and commercially exploit the foregoing. If and to the extent customer is required to license or approve such use or ownership of such Data and Images by NGS, customer hereby does so, and hereby assigns any necessary rights to NGS. If NGS makes available copies of the Data and/or Images to customer with respect to customer’s own submitted items, then customer also has the non-exclusive right and permission to use such copies of such Data and/or Images of such items as legally permissible. Without limiting the generality of the foregoing, we may elect, in our discretion, for the publication and republication or to post Images in our online gallery, to make them searchable and/or sortable, and/or to let viewers “like” or “share” them on Social Media, and/or we may elect to keep an online library or history of all your submitted Items that you have submitted to the NGS. Without limiting the generality of the foregoing, customer, on behalf of itself and any third party for whom customer may be acting with respect to this agreement, unconditionally and irrevocably transfers, conveys and assigns to NGS any and all current and any hereafter acquired rights, title and interests (including, without limitation, rights in copyright, patent, trade secret and trademark) that customer or any such third party may have in or to the Data and the Images (on whatever media or in whatever form such Images may be reproduced or published).
We reserve the right to modify or discontinue any Services at any time with or without notice to you, including without limitation by adding or subtracting features and functionality, third party content, etc. In the event of such modification or discontinuation of the Services, your sole remedy shall be to cease using our Services. Continued use of the Services following any such changes will indicate your acknowledgement and acceptance of such changes and satisfaction with the Services as so modified. We reserve the right to change these terms and conditions at any time with or without notice to you. These terms and conditions are posted online, and you are responsible to check for updates from time to time. Any use of any part of the Services after any updates is your consent and agreement to such updated terms.
Our services, brands, holders, labels and other technology are proprietary intellectual property of NGS. You may not use nor reverse engineer any of our materials to study or endeavour to create any competing product or service, to imitate or counterfeit our Holders or labels, or to engage in any way to infringe upon our rights. You may not tamper with or alter in any way our logos, printed grades, labels or Holders, including without limitation by altering or removing our logo or grades, without our express written consent.
We are not responsible for any obligation(s) hereunder if they are delayed, impeded, or rendered prohibitively expensive, impractical or impossible by an event beyond our reasonable control, including without limitation: flood; fire; earthquake; severe weather including snow, ice, rain or wind; other acts of God or of the public enemy; explosion; war; hostility; terrorist act; civil disturbance; riot; insurrection; embargo; pandemic; epidemic; virus; lock-down; quarantine; strike; work stoppage; governmental action including without limitation changes in legislation or orders; disruptions of a) supply chains, b) utilities, c) transportation or d) internet, and/or any other similar or dissimilar events outside our reasonable control (each, a “Force Majeure Event”). We shall not be liable to you for any damages, whether or not foreseeable, arising out of or relating to the suspension or termination of any of our obligations or duties under this Agreement by reason of the occurrence of a Force Majeure Event.
The terms and conditions in this Agreement (together with our other applicable policies and terms), constitute the entire agreement of NGS and the customer (and any third party for whom customer may be acting) regarding, and supersede all prior agreements and understandings (written or oral) between or among such parties relating to, the subject matter hereof (and no prior understandings, customs or courses of dealings shall be binding on the parties hereto). If any term or provision of this Agreement is determined to be invalid or unenforceable under applicable law, such invalidity or unenforceability shall not affect the validity or enforceability of any of the other of the terms or provisions of this Agreement. No failure by NGS to enforce strictly any provision of this Agreement shall constitute a waiver of its right to enforce any other provisions of this Agreement or otherwise or to enforce the provision in question on any subsequent occasion. The rights, remedies and benefits herein are cumulative and, except as expressly set forth herein, are not exclusive of any rights, remedies or benefits which the parties hereto may otherwise have. The rights and obligations of customer hereunder may not be assigned or transferred without the prior written consent of NGS. Any attempt to do so will be void and of no force or effect. Each party shall execute and deliver such additional documents and instruments as any other party may request to better evidence or effectuate the agreements contained herein. Failure to comply with this Agreement may make you ineligible to submit any future Items for Services in our discretion.
Customers are requested to note that according to the Antiquities and Art Treasures Act, 1972 (Act No. 52 of 1972), Items (including coins and paper money) over 100 years old, cannot be exported out of India without the permission of the Director General, Archaeological Survey of India, Janpath, New Delhi.
All disputes arising out of these terms and conditions are solely subject to the jurisdiction of
Mumbai in the state of Maharashtra, India.
